HON'BLE SRI JUSTICE U.DURGA PRASAD RAO CRIMINAL PETITION No.3803 of 2018 ORDER:

In this petition filed under Section 482 Cr.P.C., petitioners/A4 and A5 seek to quash the proceedings against them in Cr.No.51 of 2018 of Gachibowli PS., Cyberabad registered for the offences under Sections 406, 420, 506 r/w 34 IPC.

2) A perusal of the complaint allegations would reveal prima facie accusation. Of course the truth of the same has to be investigated into. It is informed investigation is at the inceptional stage. In that view, this Court is not inclined to quash the proceedings. However, having regard to the submission of learned counsel for petitioners that the 4th petitioner is a house wife and 5th petitioner is software consultant at Hyderabad and they will abide by the directions of this Court, the Investigating Officer is directed to strictly follow the guidelines of the Apex Court rendered in Arnesh Kumar vs. State of Bihar1 and also the procedure contemplated under Section 41A Cr.P.C during the course of investigation towards the petitioners/A4 and A5, in turn they are directed to cooperate with the investigating agency for smooth completion of investigation.

3) The Criminal Petition is accordingly disposed of. As a sequel, miscellaneous applications pending, if any, shall stand closed.
