THE HON'BLE SRI JUSTI CE SANJAY KUMAR AND THE HON'BLE SRI JUSTI CE N. BALAYOGI WRI T PETI TI ON Nos.7424 and 7431 of 2017 COMMON ORDER: (Per Justice Sanjay Kumar) The petitioners are the applicants in O.A.Nos.6114 and 6101 of 2015 respectively on the file of the Andhra Pradesh Administrative Tribunal, Hyderabad. Their grievance before the Tribunal was with regard to the failure of the authorities in concluding the disciplinary proceedings initiated against them. By separate orders dated 05.11.2015 passed in both the O.As., the Tribunal directed the authorities to take a decision on the explanations submitted by the petitioners and take further action to conclude the disciplinary proceedings initiated against them within four months from the date of receipt of copy of the orders. Seeking implementation of these orders, the petitioners are before this Court by way of these writ petitions.

Learned Government Pleader for Services (Telangana) fairly concedes that no writ petitions were filed by the State against the aforestated orders passed by the Tribunal. Learned Government Pleader further states that the State of Telangana is seized of the matter and is yet to take a decision.

In the light of the undertaking given by the learned Advocate General for the State of Telangana to this Court to the effect that orders passed by the Tribunal would be implemented by the State of Telangana, unless varied or set aside, which was duly recorded by a Division Bench of this Court comprising the Hon'ble The Acting Chief Justice and the Hon'ble Sri Justice U. Durga Prasad Rao in W.P.No.31905 of 2016 vide order dated

30.09.2016, it is not open to the State of Telangana to keep the matter pending indefinitely despite the time stipulation fixed by the Tribunal. The writ petitions are accordingly disposed of directing the State of Telangana to expeditiously take a decision in the matter in terms of the orders passed by the Tribunal in O.A.Nos.6114 and 6101 of 2015 and, in any event, not later than one month from the date of receipt of a copy of this order.
