O R D E R

This criminal petition is filed under Section 482 Cr.P.C. seeking to quash the proceedings in Cr. No.56/2016 on the file of women (Mahila) Police Station, Kakinada, East Godavari District, registered against the petitioners for the offence punishable under Sections 498-A read with 34 IPC and Sections 3 and 4 of Dowry Prohibition Act. Heard the learned counsel for the petitioner and the learned Additional Public Prosecutor appearing for the State.

A perusal of the complaint reveals that specific allegations were made against the petitioner. This is a matter, which requires investigation by the police. The truth or otherwise of the allegations can only be decided during course of investigation or trial. I see no ground to interdict the investigation at this stage and quash the first information report. The learned counsel for the petitioners submitted that the petitioners 1 to 3 are residing at Hyderabad and petitioners 4 and 5 are residing at Nizamabad and the crime is registered at the women Police station at Kakinada, East Godavari District and as they are frequently called to Kakinada on the ground of investigation, they are subjected to harassment.

In the facts and circumstances of the case and as requested by the learned counsel for the petitioner, the criminal petition is disposed of, directing the investigating agency to proceed with the investigation and complete the same in accordance with law, however, without insisting upon the presence of petitioners 2 to 5, unless required for any specific purpose of investigation.

Miscellaneous petitions pending if any, shall stand closed. No costs. ------------------------------ M.S.K.JAISWAL,J
