THE HON'BLE SRI JUSTICE K.SURENDER CRIMINAL PETITION NO.3222 of 2022 ORDER:

This Criminal Petition under Section 438 Criminal Procedure Code is filed by petitioner, who is arrayed as accused No.6, seeking bail in the event of his arrest in connection with Crime No.23 of 2022 of Bela Police Station registered for the offences punishable under Sections 420, 409, 468, 471 r/w.34 of Indian Penal Code and Section 3 and 4 of Gaming Act and Section 66 of Gaming Act and 66 of Information Technology Act. 2.

Heard the learned Counsel appearing for the petitioner and learned Assistant Public Prosecutorrespondent, for the State. 3.

As seen from the record, the allegation against the petitioner is that he had provided bank details to Accused No.1, who transferred an amount of Rs.55,00,000/- into the account of this petitioner and subsequently even according to the remand report the

account of this petitioner was operated by Accused No.1, which is not disputed by the Assistant Public Prosecutor on the basis of remand Case Diary and instructions. In the said scenario when the account of this petitioner was created and operated by Accused No.1, at best, the petitioner can be witness to the fraud perpetrated by accused No.1.

In the said circumstances, the petitioner can be granted the relief of anticipatory bail

4. The Criminal Petition is, accordingly, allowed and the petitioner-Accused No.6, is granted anticipatory bail subject to the following terms and conditions:

(1) The petitioner/A6 is directed to surrender before the Station House Officer, P.S.Bela, within ten days from the date of this order, and, on such surrender, the petitioner is directed to be released on bail on his executing a personal bond to the tune of Rs.10,000/- (Rupees ten thousand only) with two sureties to the like sum each to his satisfaction.

(2) The petitioner/Accused shall abide by the other conditions stipulated in Section 438(2) Cr.P.C and co-operate with the Investigating Officer in investigating the case as and when required.

Miscellaneous applications, if any pending in this criminal petition, shall stand closed.
