This petition is filed seeking transfer of C.C.No.1535 of 2015 pending on the file of XI Additional Chief Metropolitan Magistrate, Secunderabad to any Court at Nampally, Hyderabad. 2.

Heard the learned counsel for the petitioner and learned Public Prosecutor for first respondent. None appears for the second respondent, in spite of notice.

The ground on which the transfer is sought for is that the XI Additional Chief Metropolitan Magistrate, Secunderabad, in spite of there being a discharge petition pending, which is filed by the petitioner, is going ahead with further proceedings of the case without disposing of the said discharge petition. That, in the considered opinion of this Court, cannot be a valid ground for transfer of the case. However, the learned XI Additional Chief Metropolitan Magistrate, Secunderabad is directed to dispose of the discharge petition, which is filed by the petitioner herein, by numbering it and later on, proceed with the further proceedings, if necessary.

With the above direction, this petition is disposed of. As a sequel, the miscellaneous applications, if any pending, shall stand closed.
