THE HON'BLE SRI JUSTICE K.SURENDER CRIMINAL PETITION No. 3254 of 2022 ORDER:
This Criminal Petition under Section 438 Cr.P.C. is filed by petitioner/accused No.1 seeking bail in the event of his arrest in connection with Crime No. 5/2022 on the file of Rudrangi Police Station, Rajanna Siricilla District, registered for the offences punishable under Sections 447, 307 r/w.34 of IPC.

The allegation in the complaint is that there are disputes regarding agricultural land in the village; and that the petitioner filed injunction application during the civil disputes regarding the said agricultural land. On 27.01.2022, the defacto complainant and the petitioner herein along with others engaged in altercation leading to injuries on both sides. The petitioner filed photographs showing that he received serious injuries on the scalp and the right leg plastered. It is a case and counter case (Crime No.6/2022) resulting in fight against two groups for the said agricultural land.

In view of the injuries received and also the nature of allegations, the petitioner can be granted the relief of Anticipatory Bail subject to the following terms and conditions:
1) The petitioners/ accused No.1 is directed to surrender before the Station House Officer, Rudrangi Police Station, Rajanna Siricilla District, and on such surrender, the said Station House Officer shall release the petitioner/ accused No.1 on bail on his executing a personal bond to the tune of Rs.20,000/- (Rupees twenty thousand only) with two sureties to the like sum each to his satisfaction.
2) The petitioner/ accused No.1 shall abide by the other conditions stipulated in Section 438(2) Cr.P.C and co-operate with the Investigating Officer in investigating the case.
3) The petitioner/accused No.1 shall make available himself for investigation.
Miscellaneous applications, if any pending in this criminal petition, shall stand closed.
