THE HONOURABLE SRI JUSTICE RAJA ELANGO Criminal Petition No.4341 of 2016 ORDER:

Petitioners/Accused Nos.1, 2 and 5 approached this Court with a prayer to quash the proceedings initiated against them in C.C.No.120 of 2016 on the file of the X Metropolitan Magistrate, Cyberabad, Malkajgiri, Hyderabad, wherein they are facing trial for the offences punishable under Sections 420 and 498-A I.P.C. and Sections 3 & 4 of Dowry Prohibition Act.

Heard and perused the material available on record. A reading of charge sheet also reveals some allegations against petitioners, truth of which can be decided only after due trial. Hence, this Court is not inclined to interfere with the proceedings against petitioners.

In any event, considering the nature of allegations wherein the question of identity of the accused does not arise, presence of petitioners before the trial Court is dispensed with except on the dates of framing of charges

and examination under Section 313 Cr.P.C. However, petitioners shall be properly represented through their counsel before the trial Court.

Accordingly, the Criminal Petition is disposed of. Consequently, Miscellaneous Petitions pending in this petition, if any, shall stand closed.
