THE HON'BLE SRI JUSTICE P. NAVEEN RAO WRIT PETITION No.7970 OF 2010 Date:09.03.2017 Between:

Syed Mahaboob Subhani, S/o. Jailabddin, Aged about 47 years, D.No.26-14-98, Raghuram Nagar, Nagarampalem, Guntur, L.D.C. S.E. Operation, ERO, Tenali and others .. Petitioners And Government of A.P., rep., by its Special Chief Secretary, Energy Department, Secretariat, Hyderabad and others .. Respondents

THE HON'BLE SRI JUSTICE P. NAVEEN RAO WRIT PETITION No.7970 OF 2010 ORDER:

Petitioners challenge the order of suspension. One of the grounds urged was that some of the employees were already reinstated into service, whereas the petitioners continued to be under suspension.

2.

This Court, by order dated 07.06.2010 in W.P.M.P.No.10246 of 2010, directed respondents 2 and 3 to reinstate the petitioners into service.

3.

In the counter affidavit filed on behalf of respondents 2 and 3, it is admitted that the petitioners were reinstated into service pursuant to the interim orders. Therefore, so far as revocation of suspension is concerned, cause in the Writ Petition does not survive as the petitioners were already reinstated into service and continued to be in service. However, learned counsel for both parties are unable to inform the Court as to the stage of disciplinary action. Thus, on revocation of suspension, regularisation of period of suspension would ultimately depend on the final orders to be passed, if not already passed in the disciplinary proceedings. 4.

Subject to the above, the Writ Petition is disposed of. There shall be no order as to costs.

Miscellaneous Petitions, if any, pending in this Writ Petition shall stand closed.
