THE HON'BLE SRI JUSTICE SANJAY KUMAR AND THE HON'BLE SRI JUSTICE N. BALAYOGI WRIT PETITION No.6381 of 2017 ORDER: (per Hon'ble Sri Justice Sanjay Kumar) The writ petition was filed seeking implementation of the order dated 06-09-2016 passed by the Andhra Pradesh Administrative Tribunal, Hyderabad, in O.A.No.1726 of 2016. The said O.A. was filed by the petitioner herein assailing the Memo dated 12-12-2015 and seeking a direction to the authorities to release all consequential benefits to him by treating the period of suspension suffered by him in an appropriate manner under Fundamental Rule 54-B.

By the order dated 06-09-2016, the Tribunal quashed the Memo dated 12-12-2015 and directed the Greater Hyderabad Municipal Corporation to pay a sum of Rs.8,28,305/- to the petitioner towards retiral benefits within a time frame. Sri P. Keshava Rao, learned standing counsel, took notice on behalf of the second respondent on 23-02-2017 and sought time to get instructions. However, there was no representation for the Greater Hyderabad Municipal Corporation or it's counsel when this matter was taken up for hearing during the pre-lunch session and the same situation continues despite the matter being passed over and being taken up during the post-lunch session. Sri K. Ram Reddy, learned counsel for the petitioner, informed this Court that, to his knowledge, no writ petition was filed by the authorities challenging the aforestated order passed by

the Tribunal. That being so, if the order remains in operation, it is not open to the authorities to fail to implement the same. The writ petition is accordingly disposed of directing the second respondent herein to abide by and implement the order dated 06-09-2016 passed by the Andhra Pradesh Administrative Tribunal, Hyderabad, in O.A.No.1726 of 2016 expeditiously and, in any event, not later than eight weeks from the date of receipt of a copy of this order.
