Heard the learned counsel for the petitioner and the learned Government Pleader for Excise appearing for respondents. 2.

It is stated by the learned counsel on both sides that the issue raised in this Writ Petition is covered by order dt.13-11-2017 in W.P.No.37689 of 2017.

For the reasons alike, this Writ Petition is also disposed of directing 2nd respondent to release the stocks of the petitioner i.e. 65 gunny bags of black jaggery each containing 50 kgs., total 3250 kgs., seized in Cr. No.12 of 2017, on condition of the petitioner furnishing an F.D.R. for a sum of Rs.75,000/- (Rupees Seventy Five Thousand only) in favour of the Deputy Commissioner of Prohibition and Excise, Chittoor. However, this order shall not preclude the authorities concerned from further proceeding in the matter in accordance with procedure established by law. 4.

As a sequel, the miscellaneous petitions, if any pending, shall stand closed.
