THE HON'BLE SRI JUSTICE RAJA ELANGO CRIMINAL REVISION CASE No.2270 OF 2015 ORDER:
The present criminal revision case is filed by the petitioner challenging the order, dated 11.08.2015, passed in Crl.M.P.No.290 of 2015 in M.C.No.29 of 2015, by the Court of the Judge, Family Court, Warangal, whereby the Court below directed the petitioner herein to pay an amount of Rs.10,000/- (Rupees ten thousand only) to second respondent herein and Rs.5,000/- (Rupees five thousand only) to third respondent herein payable on or before 5th of every succeeding month and also to pay the arrears of maintenance. It is further directed that the petitioner shall pay an amount of Rs.25,000/- (Rupees twenty five thousand only) towards legal expenses to the second respondent.
Heard and perused the records.
Learned counsel for the petitioner submitted that the petitioner herein is unable to pay the amount of Rs.15,000/- to the respondents 2 and 3 as ordered by the Court below and as such, prays this Court to reduce the maintenance amount. Considering the facts and circumstances of the case, the criminal revision case is disposed of with the following directions.
(i) The petitioner herein is directed to pay 50% of the monthly maintenance ordered by the Court below, i.e., Rs.5,000/- (Rupees five hundred only) to the second respondent, and Rs.2,500/- (Rupees two thousand and five hundred only) to the third respondent payable on or before 10th of every month; (ii) The petitioner is also directed to pay the arrears of maintenance amount calculating at 50% of the maintenance amount ordered by the Court below, within a period of three months from the date of this order; (iii) The order of the Court below with regard to the legal expenses is concerned, the petitioner is directed to pay the said sum of Rs.25,000/- (Rupees twenty five thousand only) within a period of three months; and
(iv) The trial Court is directed to dispose of M.C.No.29 of 2015 as expeditiously as possible, preferably within a period of six months. With the above directions, the Criminal Revision Case is disposed of. Consequently, the miscellaneous petitions filed in this revision, if any, shall stand closed.
