HON'BLE SRI JUSTICE U.DURGA PRASAD RAO I.A.No.1 of 2018 in Crl.P.No.3804 of 2018 and Crl.P.No.3804 of 2018 COMMON ORDER:

The defacto complainant and her counsel Sri Syed Kareemuddin are present. Accused Nos.1 and 2 and their counsel Sri K.Ravinder are present. Both the parties are identified by their respective counsel.

2) Heard both sides and perused the petitions.

3) On the complaint lodged by the defacto complainant, the Police of Maredpally PS, Hyderabad City, registered a case in Crime No.69 of 2015 and after investigation laid charge sheet against A1 and A2 for the offences under Sections 448 and 506 IPC. The learned X Additional Chief Metropolitan Magistrate, Secunderabad has taken cognizance and registered the same as C.C.No.478 of 2015. 4) At this stage, defacto complainant filed Crl.P.No.3804 of 2018 to quash the proceedings against accused Nos.1 and 2 in C.C.No.478 of 2015.

5) When the matter is pending, both parties filed I.A.No.1 of 2018 seeking permission of this Court to compound the offence. It is seen that offences under Sections 448 and 506 IPC are compoundable. The parties would submit they are relations and at the intervention of elders both parties have amicably resolved their disputes and entered

into a compromise and want to compound the offence. The allegations made in the charge sheet will have no impact on the society and further no useful purpose will be served by referring them to the trial. Considering it and also the decision reported in Gian Singh v. State of Punjab and another1, I.A.No.1 of 2018 is allowed and the parties are permitted to compound the offences involved in C.C.No.478 of 2015 on the file of the X Additional Chief Metropolitan Magistrate, Secunderabad. Consequently, the Criminal Petition No.3804 of 2018 is allowed and the proceedings against A1 and A2 in the said C.C.No.478 of 2015 are quashed and accordingly, they are acquitted. As a sequel, miscellaneous petitions pending, if any, shall stand closed.
