Heard the learned Counsel for the petitioner and the learned Government Pleader for the respondents.

The petitioner was appointed as a fair price shop dealer of Shop No.46 of Garladinne Village, Hamlet of Madhavaram Village, Peapully Mandal in Kurnool District. When the authorisation of the petitioner was earlier suspended by the third respondent, the petitioner filed W.P.No.38272 of 2014, and when a submission was made by the learned Government Pleader in the said Writ Petition that the authorisation of the petitioner was restored, the said Writ Petition was closed on 12.12.2014.

Again the third respondent issued the impugned proceedings dated 20.03.2015 suspending the authorisation of the petitioner on various grounds. Challenging the same, the present Writ Petition is filed.

Learned Counsel for the petitioner submits that no show cause notice was issued to the petitioner even though the authorisation of the petitioner was suspended way back on 20.03.2015. In the circumstances, the Writ Petition is disposed of directing the third respondent to issue a show cause notice, if the third respondent wants to conduct an enquiry in respect of the allegations or restore the authorisation, if he does not want to conduct the enquiry. If the third respondent feels to issue a show cause notice, he should invite an explanation from the petitioner and complete the enquiry by observing the principles of natural justice. The entire exercise shall be completed within a period of sixty days from the date of receipt of a copy of this order.

The Writ Petition is, accordingly, disposed of. The miscellaneous

petitions pending, if any, shall stand closed. There shall be no order as to costs.
