THE HON'BLE SRI JUSTI CE M.SEETHARAMA MURTI A.S. No.2492 of 1999 JUDGMENT:

As there was no representation for the appellant on 12.10.2011, there was a direction to post the appeal under the caption "for dismissal". Accordingly, the Registry posted the matter today under the caption "for dismissal", following the further orders of this Court, dated 24.01.2018.

Today also, there is no representation for the appellant. From the conduct of the appellant, it is apparent that he is not interested in prosecuting the appeal.

However, learned counsel for the respondent brings to the notice of this Court that the respondent died long back and no steps, as required under law, are taken to bring on record the legal representatives of the deceased sole respondent and that the Appeal Suit stands abated.

In the result, the appeal is dismissed as abated. No order as to costs. Miscellaneous petitions, pending if any, also shall stand dismissed.
