HON'BLE SRI JUSTICE C. PRAVEEN KUMAR CRIMINAL REVISION CASE No.72 of 2015 ORDER:
The present revision is filed under Sections 397 and 401 of Cr.P.C. aggrieved by the order dated 14.11.2014 passed in Crl.M.P.No.2207 of 2014 in C.C.No.269 of 2013 by the XV Additional Chief Metropolitan Magistrate, Hyderabad, wherein and whereunder the application filed for discharge was rejected. Though the present revision is filed questioning the order dated 14.11.2014, the learned counsel for the petitioners/accused Nos.3 to 6 restricts his prayer seeking dispensation of presence of the petitioners before the trial Court on every date of adjournment, on the ground that it is difficult for them to attend the Court on every date of adjournment.
The learned Public Prosecutor submits that as there is no dispute with regard to the identity of the petitioners, their presence may not be necessary on every date of adjournment. Having regard to the facts and circumstances of the case and taking into consideration the nature of allegations and since there is no dispute with regard to the identity of the petitioners, the presence of the petitioners/accused Nos.3 to 6 in C.C.No.269 of 2013 on the file of the XV Additional Chief Metropolitan Magistrate, Hyderabad, is hereby dispensed with except on the dates of framing of charges, examination of the accused under Section 313 of Cr.P.C. and on the date of judgment.
With the above direction, the Criminal Revision Case is disposed of.
As a sequel, miscellaneous petitions pending, if any, shall stand closed.
