O R D E R
Alleging encroaching on the subject property by third parties, petitioners approached the Hon'ble Lokayukta, who by order dated 29.10.2013, directed the police concerned to call the petitioners and do the needful to protect their rights. The grievance of the petitioner is that though they approached respondents 3 and 4 - police authorities vide complaint dated 17.07.2018, no action has been taken. Hence, the present writ petition.
Heard the learned counsel for the petitioners. Learned Assistant Government Pleader for Home, on instructions, submits that petitioners are seeking police protection to the subject property, and unless there are orders from competent civil court, police cannot provide protection. The Hon'ble Lokayukta in Complaint No.2331/2012/B2 dated 29.10.2013 passing the following order:
"In the circumstances, the Superintendent of Police, Khammam is directed to instruct the concerned Police of the area within which the Chalamal Village of Chrla Mandal falls and he shall call for the complainant and do the needful to protect the rights of the complainant and ultimately the Rule of Law. The complainant shall also meet the Superintendent of Police, Khammam with a copy of this order."
Even Hon'ble Lokayukta also directed to follow the rule of law, and as the petitioners are alleging encroachment, they are required to approach a competent civil court and establish their right for seeking appropriate relief. In view of the above, writ petition is disposed of leaving it open to the petitioner to approach a civil court and seek appropriate relief. Interlocutory applications pending, if any, shall stand closed. No order as to costs.
