Heard counsel for the petitioner and the Government Pleader for Excise appearing for respondents.

It is stated by counsel on either side that the issue raised in the Writ Petition is covered by the order dt.13.11.2017 in WP.No.37689 of 2017.

Therefore, for reasons alike, this Writ Petition is also disposed of directing the 2nd respondent to release the stocks of the petitioner i.e., 358 boxes of white jaggery each containing 19 Kgs. (6802 Kgs) and 211 bags of alum each containing 50 kgs.,(10550 kgs) seized in the Crime No.58 of 2018 on condition of the petitioner furnishing a fixed deposit receipt for Rs.1,25,000/- in favour of the Deputy Commissioner of Prohibition and Excise, Adilabad District. However, this order shall not preclude the authorities from further proceeding in the matter in accordance with procedure established by law. No order as to costs. 4.

Consequently, miscellaneous petitions pending, if any, shall stand dismissed.
