THE HON'BLE SRI JUSTICE P.NAVEEN RAO WRIT PETITION No.12734 OF 2019 Date:31.07.2019 Between:
G.K. Krishna, S/o. Late G. Narayana, Aged about 55 years, Occ: Employee, R/o. H.No.5-1-39, Premavathipet Village, Rajendranagar Mandal, GHMC, Ranga Reddy District .. Petitioner And The State of Telangana, rep., by its Principal Secretary, Stamps and Registration Department, Secretariat, Hyderabad and others .. Respondents The Court made the following:
THE HON'BLE SRI JUSTICE P.NAVEEN RAO WRIT PETITION No.12734 OF 2019 ORDER:
Heard learned counsel for the petitioner and learned Government Pleader for Revenue.
2.
Petitioner made representations, dated 11.09.2018 and 25.09.2018, respectively, to the Sub-Registrar, Rajendranagar Mandal, and the District Registrar, Ranga Reddy District, requesting them to cancel the gift deed in document No.950 of 2010 and to appoint an officer to enquire into the matter. Petitioner claimed that on property belonging to him false gift settlement deed was registered behind his back and the same is not valid in law. In other words, petitioner was requesting to cancel the document which was already registered. By letter dated 06.10.2018, petitioner was informed that such request cannot be entertained and if the petitioner has any grievance, he has to work out his remedies as available in law. Challenging the said letter, petitioner filed this Writ Petition. 3.
From a bare reading of the representations, in response to which the impugned letter was given, itself would show that the petitioner has grievance against registration of gift settlement deed. However, once document is registered, the registering authority is not competent to suo-motu cancel the document already registered. Therefore, the Court does not see any error in the reply furnished through the letter, impugned in the Writ Petition.
4.
The Writ Petition is accordingly dismissed leaving it open to the petitioner to work out his remedies as available in law. Miscellaneous Petitions, if any, pending in this Writ Petition shall stand closed.
