HON'BLE SRI JUSTICE P.NAVEEN RAO ORDER:
The petitioners claim to be the existing pensioners. The petitioners were granted pension about five years back under the various social welfare schemes launched by the Government for widows, disabled persons, old age persons, etc. Petitioners 1 to 8 and 10 are widows, 9th petitioner is a disabled person and all others are old age pensioners. Suddenly, the pension was stopped to the petitioners without assigning any reasons. Aggrieved by illegal denial of pension as per their entitlement, the petitioners represented to the District Collector, Prakasam District, Ongole (2nd respondent) under Prajavani Programme. The 2nd respondent in turn directed the Project Director, District Rural Development Authority, Ongole, Prakasam District (3rd respondent) to take appropriate action. The 3rd respondent in turn directed the Mandal Parishad Development Officer, J.
Panguluru Mandal, Prakasam District (4th respondent) to take appropriate action on the representation of the petitioners. It appears that the Panchayat Secretary, Nuzellapalli Gram Panchayat, Nuzellapalli Village, J. Panguluru Mandal, Prakasam District (5th respondent) has looked into the record and found that the petitioners are eligible
for grant of pension. Having looked into the grievance of the petitioners, the Mandal Parishad Development Officer seems to have submitted a report on 16.12.2014 addressed to the District Collector, Ongole, Prakasam District (2nd respondent) marking a copy to the Project Director, District Rural Development Authority, Ongole, Prakasam District (3rd respondent). The grievance of the petitioners is that in spite of report being submitted about entitlement of the petitioners, so far, no decision is taken.
2. Having regard to the submission of the petitioners that a report in their favour is already been submitted by the Mandal Parishad Development Officer, the Writ Petition is disposed of, without expressing any opinion on merits, directing the Project Director, District Rural Development Authority, Ongole, Prakasam District (3rd respondent) to consider the eligibility of the petitioners having regard to the reports submitted by the Mandal Parishad Development Officer in his letter, dated 16.12.2014, and communicate his decision to the petitioners within a period of two (2) weeks from the date of receipt of a copy of this order. If the petitioners are aggrieved by any adverse decision, it is open to them to work out their remedies. There shall be no order as to costs. Miscellaneous petitions, if any, pending in this writ petition shall stand closed.
