THE HON'BLE SRI JUSTI CE SANJAY KUMAR AND THE HON'BLE MS. JUSTI CE J.UMA DEVI CONTEMPT CASE NO.862 of 2018 ORDER: (per SK,J) This contempt case was instituted alleging wilful, wanton and deliberate violation of the common judgment dated 19.12.2017 passed by this Court in so far as it relates to LAAS.No.330 of 2015. By the said common judgment dated 19.12.2017, this Court disposed of the appeals directing payment of compensation at Rs.100/- per square yard along with statutory benefits in accordance with law.

Sri Harender Pershad, learned Special Government Pleader attached to the office of the learned Additional Advocate General, State of Telangana, placed before this Court the letter dated 03.07.2018 addressed by the Revenue Divisional Officer, Rajendranagar Division, Ranga Reddy District, to the learned I Additional Senior Civil Judge, Ranga Reddy District at L.B.Nagar, stating that a sum of Rs.48,96,457/- was deposited to the credit of LAOP.No.18 of 2009 from which LAAS.No.330 of 2015 arose.

The break up of the compensation deposited was also appended to the said communication.

In the light of this development, the common judgment passed by this Court in so far as it relates to LAAS.No.330 of 2015 stands duly complied with.

Learned counsel representing Sri Ch.Siddhartha Sarma, learned counsel for the petitioner, would however assert that the calculation by the authorities concerned is incorrect.

We are of the considered opinion that this aspect of the matter cannot be subjected to resolution in contempt proceedings. In the event

the petitioner has any grievance with regard to the quantification of the compensation payable in terms of the directions passed by this Court in the aforestated common judgment, it is for him to take independent steps in accordance with law to seek redressal thereof. Leaving it open to the petitioner to do so, the contempt case is closed. No order as to costs.
