THE HON'BLE SRI JUSTICE C.V.NAGARJUNA REDDY AND THE HON'BLE SRI JUSTICE G.SHYAM PRASAD W.P.No. 32682 OF 2016 DATED 27TH SEPTEMBER, 2016 Between:

Erkulla Dayanand ...

Petitioner AND Indian Overseas Bank, Rep. by its Branch Manager, Hanmakonda Branch, 2-5-74, Nakkalagutta, Warangal - 506001 ...

Respondent Counsel for the petitioner :

Sri P.Devender Counsel for the respondent :

-- THE COURT MADE THE FOLLOWING

CVNR, J. & GSP, J.

wp_32682_2016 ORDER: (per Hon'ble Sri Justice C.V.Nagarjuna Reddy) Feeling aggrieved by rejection of one time settlement offer (for short, 'OTS') made by the petitioner by the respondent, the present Writ Petition is filed. 2.

Sri Parsa Ananth Nageswar Rao, learned counsel, representing Sri P.Devender, learned counsel for the petitioner, submitted that since the respondent has rejected the petitioner's OTS offer on the sole ground that he has not indicated the amount for which he sought for the OTS, the petitioner may be permitted to approach the respondent with the firm offer and that the latter may be directed to consider the same and pass a fresh order. 3.

In view of the innocuous submission of learned counsel for the petitioner as noted above, the Writ Petition is disposed of, without expressing any opinion on the merits of the case, by permitting the petitioner to make a fresh OTS offer as proposed by his counsel. As and when such offer is made, the respondent shall consider the same, take a decision and communicate the same to the petitioner.

4.

Subject to the above direction, the Writ Petition is disposed of. 5.

As a sequel to disposal of the Writ Petition, W.P.M.P.No. 40451 of 2016 shall stand closed as infructuous.
