THE HON'BLE DR.JUSTICE SHAMEEM AKTHER CRIMINAL REVISION CASE NO.880 OF 2018 ORDER:

This revision is filed by the petitioner-accused under Sections 397 and 401 Cr.P.C. challenging the order, dated 14.03.2018 in Crl.M.P.No.390 of 2018 in Crl.A.No.80 of 2018 on the file of the I Addl. District and Sessions Judge, Ongole, 2.

Heard learned counsel for the petitioner-accused and perused the record.

Learned counsel for the petitioner-accused would submit that the 1st appellate Court directed the petitioneraccused to pay 1/4th (one fourth) of the fine amount, which is excessive. There is no provision to impose such fine amount and ultimately prayed to set aside the impugned order.

It is brought to the notice of this Court that the petitioner is a lorry driver. Under these circumstances, the petitioner-accused is directed to deposit Rs.1,00,000/- (Rupees one lakh only) before the Special Judl. Magistrate of I Class, Excise Court, Ongole, in stead of 1/4th (one fourth) of fine amount of Rs.5,60,000/- as ordered by the 1st appellate Court.

Accordingly, the Criminal Revision Case is ordered. Miscellaneous petitions, if any pending in this Revision shall stand closed.
