THE HONOURABLE SRI JUSTICE RAJA ELANGO CRL.A.M.P.No.167 of 2016 & CRIMINAL APPEAL No.1336 of 2014 JUDGMENT:

Challenging the judgment dated 11.12.2014 passed by the Special Judge for SC/ST (POA) Cases-cum-VII Additional District Judge at Warangal in S.S.C. No.41 of 2012 in convicting the appellant for the offence under Section 417 IPC and under Section 3(1)(xii) of Scheduled Castes & Scheduled Tribes (Prevention of Atrocities) Act and sentencing him to undergo R.I. for six months and to pay a fine of Rs.500/-, in default to suffer S.I. for one month for the offence under Section 417 IPC and sentencing him to undergo R.I. for one year and to pay a fine of Rs.1000/-, in default, to suffer S.I. for two months for the offence under Section 3(1)(xii) of SCs & STs (POA) Act, the appellant-accused preferred the present appeal. When the matter is taken up for hearing, the de facto complainant filed Crl.A.M.P.No.167 of 2016 stating that she entered into compromise with the accused-appellant herein and therefore, prayed to grant permission to compound the offence and to set aside the conviction and sentence imposed against the appellant-accused.

Both the parties as well as their counsel have signed on the memorandum of compromise annexed to Crl.A.M.P.No.167 of 2016. The parties, who are present in the Court, also affirmed the same. A perusal of the affidavit filed in support of the petition goes to show that the matter was settled between the parties.

In view of the amicable settlement of the dispute between the parties and in view of the nature of the offence, Crl.A.M.P.No.167 of 2016 is ordered and the compromise is recorded. Consequent thereto, the Criminal Appeal is allowed setting aside the judgment dated 11.12.2014 in S.S.C. No.41 of 2012 passed by the Special Judge for SC/ST (POA) Cases-cum-VII

Additional District Judge at Warangal. It is directed that this compromise shall form part of the record.
