V. Rajavardhan Reddy v. K. Shammer

HON'BLE SMT. JUSTICE T. RAJANI M.A.C.M.A. No. 3621 OF 2008 JUDGMENT:

This appeal is placed before me following the award passed by the Lok Adalat, dated 11.02.2017. The terms of which are as follows: "1.

Sri T. Damodar, learned counsel for the appellant/petitioner and Sri K.C. Pandarinath Naik, Manager, National Insurance Company Limited and both the parties are present. The matter has been settled amicably between the parties and a compromise was entered into whereunder the claimant agreed to receive a further amount of Rs.1,35,000/- in addition to the amount already deposited and in full and final settlement of all claims including interest. 2.

The 2nd respondent/Insurance Company shall deposit the amount of Rs.1,35,000/- within 60 days from this date. In the event of default, the agreed amount shall carry interest @ 12% per annum from the date of default.

The petitioner/appellant is permitted to withdraw the entire amount as and when deposited by the insurance company. Accordingly, the matter is settled.

The parties are informed that the Court fee, if any, paid by any of them shall be refunded.

No orders as to the costs of appeal."

In view of the above, the appeal stands disposed of. Miscellaneous petitions, if any, shall also stand disposed of. No costs.
