O R D E R
This Criminal Petition is filed before this Court for grant of bail to the Petitioner in SC.No.304 of 2025 on the file of learned Special Sessions Judge for Trial and Disposal of POCSO Act Cases, RR District, at LB Nagar, for the offences punishable under Section 65(2) of the BNS and Sections 3 and 4 of the POCSO Act, 2012 and Sections 3(2)(v) of the SC/ST (POA) Act, 1989.

The brief facts of the case are that the petitioner herein has not attended the trial Court on 09.03.2026 and the trial Court has issued NBW against the petitioner and remanded the petitioner to the judicial custody on 23.03.2026 and he filed an application before the trial Court for recall of the NBW and the same was dismissed by the trial Court and remanded the petitioner herein to the judicial custody.

Heard Sri K. Karuna Sagar, learned counsel appearing on behalf of the petitioner as well as Sri M. Ramachandra Reddy, learned Additional Public Prosecutor appearing for respondent-State.

Learned counsel for the petitioner submitted that, from the date of registration of the case, the petitioner herein is cooperating with the trial and also the investigating authority and there is no such antecedents pending against the petitioner. It is further submitted that the petitioner herein is regularly attending every date of hearing without fail, until 09.03.2026 and only on 09.03.2026 he could not attend the hearing as he was suffering with ill health. It is further submitted that, due to non-appearance of the petitioner on 09.03.2026, the trial Court has issued NBW against the petitioner herein and the petitioner
- 3 - herein is cooperating with the trial Court. Therefore, he prayed the Court to grant bail to him by allowing this criminal petition. 5.
On the other hand, learned Additional Public Prosecutor submitted that notice is served to the victim. Hence, he prayed the Court to dismiss the criminal petition.

In the light of the submissions made by both the learned counsel and upon perusal of the material available on record, it appears that the petitioner herein has not appeared before the trial Court on 09.03.2026 and accordingly, the trial Court has dismissed his application on the ground that he may not cooperate with the trial Court. Further, the petitioner is regularly attending the trial Court except on 09.03.2026. Considering the facts and circumstances of the case, the nature of the allegations, the stage of investigation, the duration of incarceration, this Court finds it appropriate to grant bail to the petitioner, subject to the following conditions: i.
The petitioner shall execute a personal bond for a sum of Rs.25,000/- (Rupees Twenty Five Thousand only), with two sureties for a like sum each to the satisfaction of learned Special
- 4 - Sessions Judge for Trial and Disposal of POCSO Act Cases, RR District, at LB Nagar.
ii.
The petitioner shall appear before the concerned SHO at 11:00 a.m., on every Monday for a period of eight (8) weeks or till filing of charge sheet whichever is earlier, for the purpose of investigation, and thereafter, as and when required.
iii.
The petitioner shall abide by conditions stipulated in Section 437(3) of Cr.P.C. (presently, Section 480(3) of the BNSS).
iv.
The petitioner shall cooperate with the trial Court by attending before the trial Court on every adjournment.

Accordingly, the Criminal petition is allowed. Miscellaneous applications, if any pending, shall stand closed.
