THE HON'BLE SRI JUSTICE C. PRAVEEN KUMAR WRIT PETITION No.20561 OF 2016 ORDER:

Heard the learned counsel for the petitioner, learned Government Pleader for Revenue for respondents 1 to 4 and the learned Government Pleader for Mines and Geology, for respondent No.5. With consent of the counsel appearing for both sides, the present Writ Petition is disposed of at the admission stage.

2 . The present writ petition came to be filed with the following prayer:

"to issue a writ order or direction more particularly one in the nature of Writ of Mandamus, declaring the action of the 4th respondent in not taking action on the letter addressed by the 5th respondent in Lr.No.6103/Q1/2015, dated 17.10.2015 for grant of quarry lease for gravel and earth over an extent of Ac.1.43 cents in RS.No.633-13 of Konda Guntur Village, Rajanagaram Mandal, East Godavari District in favour of the petitioner as illegal, arbitrary and unjust and consequently direct the 4th respondent to pass appropriate orders in this regard forthwith."

3. Though various grounds are raised in the writ petition, learned counsel for the petitioner restricts his prayer seeking a direction to the 4th respondent to consider the letter dated 17.10.2015 addressed by the 5th respondent for issuance of NOC for grant of quarry lease.

4. Learned Government Pleader for Revenue, on instructions, submits that the application made by the petitioner seeking quarry

lease for gravel and earth was rejected by the 4th respondent on 27.06.2016 and the same was communicated to the 5th respondent.

5. In view of the above, nothing survives for adjudication in this writ petition. Accordingly, the Writ Petition is dismissed as infructuous. However, the 4th respondent authorities shall communicate a copy of the rejection order to the concerned applicant within a period of one week from today. Consequently, Miscellaneous Petitions, if any, pending in this writ petition shall stand closed. There shall be no order as to costs.
