THE HON'BLE SRI JUSTICE A.RAMALINGESWARA RAO WRIT PETITION No.11329 of 2017 ORDER:

The petitioner claims that she is the absolute owner and possessor of H.No.2-3-74 situated at Vepurigeri, Mahabubnagar. She claims that she purchased the said property from one Sri R.Nagi Reddy for a valid sale consideration under registered document. Her name was mutated in the municipal records. Respondent Nos.3 to 6 are her neighbours. The husband of the third respondent was interfering and later on he died. It appears that he entered into an agreement of sale with Nagi Reddy, who sold the house to the petitioner. The petitioner filed O.S.No.280 of 2001 against him for declaration of title and injunction and the husband of the third respondent filed O.S.No.26 of 2002 for specific performance of contract and injunction against the petitioner and the said Nagi Reddy.

Both the suits were filed before the learned Junior Civil Judge, Mahabubnagar. The suit filed by the husband of the third respondent was decreed, whereas the suit filed by the petitioner was dismissed. Appeals preferred by the petitioner were also dismissed on 19.09.2016. The petitioner states that she is contemplating to file the Second Appeals. In the meanwhile, she states that she was taken to the Police Station on 24.03.2017 in the evening hours and the second respondent directed her to vacate the house.

Challenging the action of the second respondent, the present Writ Petition is filed.

This Court cannot investigate into the truth or otherwise of the allegations of the petitioner with regard to the alleged highhandedness of the second respondent, who is trying to interfere in the civil disputes. If there is any truth in the allegation, the petitioner should lodge a complaint with the higher officer.

In the circumstances, this Writ Petition is disposed of giving liberty to the petitioner to submit a representation to the Superintendent of Police, Mahabubnagar District. As and when the petitioner submits such representation, the Superintendent of Police shall cause an enquiry into the highhandedness of the second respondent and take appropriate action in accordance with law. The miscellaneous petitions pending in this Writ Petition, if any, shall stand closed. There shall be no order as to costs.
