The case of the petitioners is that despite having validly granted pattas, the Respondent authorities are high handedly interfering with their peaceful possession and enjoyment over the subject land. 2.

A counter affidavit deposed by the Forest Divisional Officer, Bhupalapally Division of Jayashankar Bhupalapally District is filed, denying the allegations made in the writ affidavit and further stated therein that the 4th respondent and his subordinates have not entered in Sy.No.26/1, 26/1/P/P or any other revenue land. It is also stated that the offence case was booked against A1 to A5 by the respondents for violation of Forest Act and registered offence case vide POR No.27/37 dated 3.2.2015 for illegally entering into Reserve Forest Compartment No.416 and 418 of Tadicherla Forest Block of Shatrajpally Beat of Range Koyyur of Jayashankar Bhupalapally District. 3.

Grant of pattas in favour of the petitioners is not in dispute. No counter affidavit is filed by the Revenue Department. On the other hand, reiterating the contents made in the counter affidavit filed by the Forest Department, it is submitted by the learned Government Pleader that the Forest Department is concerned only to the extent of lands covered by Reserved Forest Area and if there is any encroachment upon Reserved Forest land, the authorities will take action in accordance with law. 4.

In view of the same, the writ petition is disposed of, with a direction to the Respondent authorities not to meddle with the lands in the given survey numbers covered by pattas granted in favour of petitioners. However, this order will not preclude the Respondents from taking action against the

persons encroaching upon the reserved forest area. As a sequel, the miscellaneous petitions, if any, shall stand closed. There shall be no order as to costs.
