THE HON'BLE SRI JUSTICE A.V.SESHA SAI W.P.No.10813 of 2015 O R D E R:

This writ petition, filed under Article 226 of the Constitution of India, seeks the following relief:

"Issue an order or direction more particularly one in the nature of Writ of MANDAMUS (a) declare the action of the respondents Devasthanam in not releasing the pensionary benefits of the petitioner though he retired on 31.12.2014 on attaining the age of 60 years by taking into consideration of the judgment rendered in W.P. No. 17518 of 2010 dated 12.08.2013 and also W.P. No. 8564 of 2012 and batch is illegal, arbitrary, discriminatory and violation of Articles 14, 16 and 21 of the Constitution of India; and (b) consequently direct the respondents Devasthanam to release the retirement benefits by treating the age of superannuation as 60 years and settle the benefits with all consequential benefits."

Today, when the matter is called, it is submitted by the learned counsel for the petitioner that the issue in the present writ petition is squarely covered by the common by this Court in W.A.No.230 of 2003 and Batch, dated 27.07.2010 and W.P.No.15234 of 2013, dated 29.05.2013 and the copies of the same are filed along with the writ petition as material paper.

3. Following the above referred common order and for the reasons recorded therein, this writ petition is allowed, directing the respondents herein to release pension benefits of the petitioner by treating the date of retirement of the petitioner as 31.12.2014. As a sequel, the miscellaneous petitions, if any, shall stand closed. There shall be no order as to costs.
