THE HONOURABLE SRI JUSTICE C.PRAVEEN KUMAR WRIT PETITION No.7044 OF 2009 ORDER:

This Writ Petition, under Article 226 of the Constitution of India, came to be filed seeking to direct the 1st respondent to constitute a Commissioner of Enquiry by an Independent Body to enquire into the irregularities committed in the allotment and execution of the Housing Scheme under Indiramma Gruhalu in Komarada Village and Mandal and Gangirevuvalasa Panchayati and Somanaiduvalasa Village of Vizianagaram District and recover the amounts from the unintended beneficiaries such as the Political leaders, mediators and to prosecute the irresponsible and corrupt officers.

On 06.04.2009, this Court admitted the writ petition and thereafter the matter was list on 11.09.2017. As there was no representation for the petitioner on 11.09.2017, the matter was directed to be listed on 12.09.2017 under the caption 'for dismissal'. Inspite of the matter being listed today under the said caption, there is no representation for the petitioner. Heard learned Government Pleader for Housing Board for respondents and perused the material on record. The averments in the affidavit filed in support of the writ petition would show that the writ petition is filed in the nature of public interest. The learned counsel for the respondents would submit that wherever specific complaints are received, the matter was enquired into.

Having regard to the above, this Court is of the view that no further adjudication is required in this writ petition, at this length of time.

Hence, the Writ Petition is dismissed.
