THE HON'BLE SRI JUSTICE CHALLA KODANDA RAM CRIMINAL PETITION No. 3418 OF 2019 O R D E R:

Seeking to quash the proceedings in Crime No. 17 of 2019 on the file of Gundala Police Station, registered against him for the offence punishable under Section 3(1)(r)(s) of the Scheduled Castes & Scheduled Tribes (Prevention of Atrocities) Act, the petitioner filed this Criminal Petition.

Heard learned counsel for the petitioner as well as the learned Public Prosecutor.

In view of the averment made in this Petition that the petitioner had asked the complainant to vacate the residential premises for utilising the same for their own purpose, the above crime was foisted against him, the Investigating Agency shall conduct investigation thereinto, duly following the procedure prescribed under Section 41-A of the Code of Criminal Procedure, before taking any further steps, as laid down by the Apex Court in Arnesh Kumar v. State of Bihar1.
