THE HON'BLE SRI JUSTICE CHALLA KODANDA RAM CRIMINAL PETITION No. 3406 OF 2019 O R D E R:

Seeking to quash the proceedings in Crime No. 95 of 2019 on the file of Dundigal Police Station, the petitioner filed this Criminal Petition.

Heard learned counsel for the petitioner as well as the learned Public Prosecutor.

In view of the averment made in this Petition that by a registered sale deed executed on 02.04.2009, the 2nd respondent - complainant had already sold the property in favour of Smt. Myathari Ganga Jamuna, W/o Ramesh, the Investigating Agency shall conduct investigation thereinto, duly following the procedure prescribed under Section 41-A of the Code of Criminal Procedure, before taking any further steps, as laid down by the Apex Court in Arnesh Kumar v. State of Bihar1.
