THE HON'BLE SRI JUSTICE M.SEETHARAMA MURTI Writ Petition No.22108 of 2008 ORDER:

This writ petition is filed seeking the following relief/s: '..to issue a Writ or Order of Direction more particularly one in the nature of Writ of Mandamus, declaring the action of the respondents in cancelling the ferrying rights of the petitioner for the year 2008-2009 from Purushothampatnam to Polavaram on the river Godavari on the ground that he did not deposit Rs.1,60,000/- which was in fact paid on 29.03.2008 and 03.04.2008 respectively, and further declaring that their action of giving a press statement in this regard dated 01.10.

208 without informing the petitioner regarding cancellation and without issuing any notice in this regard, as illegal arbitrary and violative of the principles of natural justice and it is further consequentially prayed that this Honourable Court may be pleased to call for the records in this regard and set aside the said cancellation order and pass such other order...' [Reproduced verbatim] When the matter, which is listed under the caption 'for orders', is taken up for hearing, there is no representation for the writ petitioner. This Court on 06.10.2008 while admitting the writ petition had granted an interim direction to the respondents not to disturb the ferrying activities of the petitioner from Purushothampatnam to Polvaram on the river Godavari for the contract period awarded to him, pending further orders.

The contract period is 200809. Therefore, in view of the relief sought for in the writ petition and the interim direction given by this Court, this Court is of the considered view that nothing survives for adjudication in the writ petition and that the writ petition has become infructuous.

Accordingly, the Writ Petition is dismissed as infructuous. There shall be no order as to costs.

Miscellaneous petitions pending, if any, in this writ petition shall stand closed.
