ORAL ORDER:

By order dated 8.7.2015 this Court directed not to demolish the pent house in Indhra Homes in Plot NO.9, Sy No. 848, 862 Balaji Nagar of Nellore.

Alleging that though said order was communicated to the respondent, the demolition took place contrary to the directions issued by this Court, the contempt case is filed.

In the counter affidavit deposed on 31.7.2016, it is contended that after the orders passed by this Court, no further action was taken to demolish the unauthorized constructions and structure remains as it was, after the order has come to the notice of the respondent corporation. No material is brought on record to show that even though respondent was informed about the order and in violation of the orders, deliberately the demolition took place. Having regard to the same, it is not a case of willful disobedience of the orders of this Court. It cannot be said that the respondent undertook demolition after knowing the orders passed by this Court. Therefore, there is no cause to continue the contempt proceedings. Accordingly, the contempt case is closed. No costs.
