THE HON'BLE SRI JUSTICE S.V.BHATT W.P.No.6830 of 2004 ORDER:

Learned counsel appearing for the parties submit that as this is one of the old cases, the Commissioner may be directed to dispose of the Revision expeditiously. In view of the above submission, the impugned order dated 09.02.2004 is set aside and the matter is remitted to the Commissioner for fresh consideration and disposal with the following observations:

(a) Under Board Standing Order (18), the jurisdiction of Commissioner is vide enough to go into the legality of the order not only under Revision but also the assignment in favour of petitioner and the claim of respondent No.5 herein. (b) The Commissioner calls for record from 3rd and 4th respondents forthwith and passes orders as expeditiously as possible preferably within three

(03) months from the date of receipt of copy of this order.

(c) The parties are given liberty to file memo seeking a date for hearing of the matter. The parties are directed to maintain status quo as regards possession, enjoyment etc., till disposal of the Revision.

Writ petition is accordingly disposed of. No order as to costs.

Miscellaneous petitions, if any, pending, shall stand closed.
