THE HON'BLE SRI JUSTICE MUMMINENI SUDHEER KUMAR WRIT PETITION No.18022 of 2022 ORDER:
This Writ Petition is filed seeking a Writ of Mandamus to declare the action of the third respondent in not disposing the representations dated 09.03.2022 submitted by the petitioner under Section 23 of the Maintenance of Parents and Senior Citizens Act, 2007 2.
According to the petitioner, she is aged about 80 years. She being an absolute owner and possessor of land admeasuring Ac.1.00 gts, in Survey No.132/2/3, situated in Puduru Mandal, Keverevelli Village of Vikarabad District executed a gift deed in favour of her granddaughter i.e., fifth respondent in the year 2011 with a hope that she will look after the welfare and well-being of the petitioner. As the respondent No.5 is not taking care of the petitioner well, the petitioner made a representation dated 09.03.2022 with the third respondent under Section 23 of the said Act.

Grievance of the petitioner is that the said representation dated 09.03.2022 is not being considered by third respondent.

Taking into consideration of the facts and circumstances of the case, no doubt the third respondent is under an obligation to consider the representation dated 09.03.2022 in terms of the provisions of the said Act. The Writ Petition is disposed of with the consent of both the parties directing the third respondent to consider the representation made by the petitioner dated 09.03.2022 duly putting fifth respondent on notice and pass appropriate orders within a period of six months from the date of disposal of this Writ Petition and communicate the same to the petitioner. There is no order as to costs. 5.
The miscellaneous petitions pending, if any, shall stand closed.
