HON'BLE SRI JUSTICE R.SUBHASH REDDY AND THE HON'BLE SRI Dr. JUSTICE B. SIVA SANKARA RAO F.C.A.M.P.No.208 of 2015 in/and F.C.A.No.302 of 2009 COMMON ORDER : (Per Hon'ble Sri Justice R.Subhash Reddy) F.C.A.No.302 of 2009, under Section 19 of the Family Courts Act, is filed by the appellant/wife aggrieved by the order and decree dated 29.10.2009 in F.C.O.P.No.152 of 2008 passed by the Judge, Family Court-cum-V Additional District Judge, Tirupati, whereby the petition under Section 13 (1) (ia) of the Hindu Marriage Act, 1955 filed by the respondent/husband for dissolution of marriage with the appellant/wife, was allowed. During the pendency of the appeal, the appellant/wife has filed a petition being F.C.A.M.P.No.208 of 2015 under Order 23 Rule 3 of C.P.C.

, seeking to record the compromise and dispose of the appeal in terms of Joint Memorandum of Compromise, dated 23.04.2015, filed along with the petition, which was signed by both the parties along with their advocates. In the said Joint Memorandum of Compromise, it is stated that on the advise of elders, the appellant and respondent have resolved their misunderstandings and agreed to live together.

When the matter is called, both the parties are present inperson and requested to dispose of the appeal in terms of the joint memo of compromise.

Having regard to the reasons stated in the affidavit filed in support of the petition and also in view of the settlement arrived at between the parties as stated in the joint memo of compromise, dated 23.04.2015, F.C.A.M.P.No.208 of 2015 is allowed. Consequently, F.C.A.No.302 of 2009 is allowed setting aside the order and decree dated 29.10.2009 in F.C.O.P.No.152 of 2008 passed by the Judge, Family Courtcum-V Additional District Judge, Tirupati. The terms of joint memo of compromise dated 23.04.2015 shall form part of the decree.

As a sequel, pending miscellaneous petitions, if any, shall stand closed. No order as to costs.
