HON'BLE SRI JUSTICE RAJA ELANGO Criminal Petition No.8421 of 2015 ORDER :

The petitioner, who is accused No.1 in Crime No.173 of 2014 of Kakinada II Town Police Station, East Godavari District, registered for the offences punishable under Section 498-A read with Section 34 I.P.C. and Sections 3 and 4 of Dowry Prohibition Act, 1961, filed this petition under Section 438 of Cr.P.C., seeking anticipatory bail.

The petitioner is apprehending arrest, since the trial Court issued N.B.W. against the petitioner.

Considering the same, the petitioner is directed to surrender before the Court concerned and to file an application to recall the warrant pending against the petitioner herein and on filing of such application, the trial Court is directed to recall the warrant on the same day on his executing a personal bond for Rs.10,000/- (Rupees Ten thousand only) with one surety for a like sum to the satisfaction of the said Magistrate. Further, the petitioner-accused No.1 is directed to report before the trial Court on all hearing days. If the petitioner is arrested on the basis of the warrant, the petitioner - accused No.1 is directed to be released on his executing a personal bond for Rs.10,000/- (Rupees Ten thousand only) with one surety for a like sum to the satisfaction of the Magistrate concerned. Further, the petitioner-accused No.1 is directed to report before the trial Court on all hearing days. With the above observations, the Criminal Petition is disposed of.
