Kothuru Prakasa Rao, v. Sri K. N. V. Jay Kumar
MSRJ C.C.No.1651 of 2016 HON'BLE SRI JUSTICE M.S.RAMACHANDRA RAO C.C.No.1651 of 2016 ORDER:
Heard the learned counsel for the petitioner and the learned Government Pleader for Revenue (A.P.) and the learned Government Pleader for Home (A.P.), appearing for the respondents. 2.
This Contempt Case is filed alleging willful disobedience of the order dt.01-08-2016 in W.P.M.P.No.31707 of 2016 in W.P.No.25262 of 2016. In the said order, the respondents were directed not to interfere with the possession of the subject land of the petitioner without following due process of law. 3.
Alleging that in spite of the said order, the respondents continue to interfere with the possession of the petitioner and the 2nd respondent even filed a Criminal Case against the petitioner through 1st respondent with a view to prohibit the petitioner to withdraw the Contempt Case, this Contempt Case is filed.
4.
It is now stated by the learned Government Pleaders for Home and Revenue appearing for the respondents that criminal case filed against the petitioner at instance of 2nd respondent through 1st respondent has been withdrawn in the Lok Adalat on 07-06-2017. 5.
In this view of the matter, I am not inclined to punish the respondents in the Contempt Case. However they are warned that if
MSRJ C.C.No.1651 of 2016 any further interference with the possession of the petitioner of the subject land occurs, serious view will be taken. 6.
Accordingly, the Contempt Case is closed. No costs. 7.
As a sequel, the miscellaneous petitions pending, if any, shall stand closed.
