THE HON'BLE SRI JUSTICE A.RAMALINGESWARA RAO WRIT PETITION No.33539 of 2017 ORDER:
Heard the learned Counsel for the petitioner and the learned Government Pleader for the respondents.
The petitioner claims to be the owner of an auto bearing No.AP 04 V 1654. He was transporting rice in the said auto to handover it to the MLS point, Mydukur, and while he was transporting, the auto was seized and kept in the custody of the Station House Officer, Mydukur Police Station. The petitioner states that he filed a petition before the second respondent seeking release of the auto as he is eking out his livelihood by plying the auto. The petition was filed on 14.09.2017 and when no orders were passed, the present Writ Petition is filed.
Since the petition filed by the petitioner is pending before the second respondent, this Court is not inclined to entertain the present Writ Petition for release of the auto, but directs the second respondent to consider the petition filed by the petitioner on 14.09.2017 and pass appropriate orders in accordance with law within a period of one week from the date of receipt of a copy of this order.
The Writ Petition is, accordingly, disposed of.
