THE HON'BLE SRI JUSTICE P.KESHAVA RAO WRIT PETITION NO.35111 OF 2015 ORDER:

There is no representation on behalf of the petitioner. 2.
The prayer sought in the Writ Petition is as under: " ....to issue an appropriate Writ, Order or Direction more particularly one in the nature of Writ of Mandamus to declare the inaction of the 3rd respondent in conducting investigation into Cr. No. 776/ 2013 though the said crime is registered on 30-8-2013 for the offence U/ Sec. 354 and 509 of I.P.C as being illegal, arbitrary and unjust and to grant such other relief or reliefs as this Honble Court deems fit and proper in the circumstances of the case 3.
When the matter is called, learned GP appearing for the respondent Nos. 1 to 3 placed on record, the written instructions dated 5.11.2015 issued by the Sub-Inspector of Police, Vijayawada I Town P.S., Vijayawada City.

From a perusal of the said instructions, it is revealed that on the complaint lodged by the petitioner, a case in Cr.No.776 of 2013 under Sections 354 and 59 IPC has been registered and investigation has been taken up, After investigation, the respondent Police submitted a letter to the ACP, West Zone, Vijayawada City with a request to accord permission to refer the case as " False" . As per the orders of the ACP vide C.No.894/ ACPWZ/ 2015 dated 31.10.2013, the same was placed before the learned Chief Metropolitan Magistrate Court, Vijayawada on 21.2.2014 vide C.F.No.1294 of 2014 and orders are awaited from the learned Magistrate.

In view of the same, this Court is of the opinion that no further orders are required in the Writ Petition.

Placing the said written instructions on record, the Writ Petition is closed.
Pending miscellaneous petitions, if any, shall also stand closed. No order as to costs.
