Shyamnagar Cricket Club v. The Hyderabad Cricket Association
THE HON'BLE SRI JUSTICE P. NAVEEN RAO CIVIL REVISION PETITION No. 995 of 2010 ORDER:
Petitioners filed O.P.No.2248 of 2006 on the file of the Chief Judge, City Civil Courts, Hyderabad, praying to grant the following relief:
"A) to declare that the 1st petitioner club as represented by its petitioners office bearers is the true and legal body entitled to be recognized and permitted to play league matches by the 1st respondent, without reference/intervention of the 2nd respondent; and B) to direct the 1st respondent to forebear and refrain from recognizing or in any way extending any affiliation to the 2nd respondent or any of his associate in the name of Shyamnagar Cricket Club."
The said O.P. was dismissed by order, dated 30.09.2009. Aggrieved thereby, this civil revision petition is filed. 2.
By order dated 31.12.2012, counsel for the petitioner is directed to pay bata and produce correct address for service of notice on un-served respondents in four weeks. He was also permitted to take out personal notice to the un-served respondents. It was further directed that if the said order is not complied with, the civil revision petition would stand dismissed without any reference to the Court. 3.
As could be seen from the endorsement made in the first page of the revision petition, the revision petition was dismissed against
PNR,J C.R.P.No..995 of 2010 the 2nd respondent for default, in accordance with the order of this Court dated 31.12.2012.
4.
Counsel for the petitioner as well as the 1st respondent informed the Court that the 2nd respondent died. 5.
As noticed in the prayer sought in the O.P., the grievance against the 2nd respondent was with regard to his intervention, and a direction was sought to the 1st respondent to refrain from recognizing or in any way extending any affiliation to the 2nd respondent or any of his associates in the name of Shyamnagar Cricket Club. Since the revision was dismissed against the 2nd respondent and also the 2nd respondent died later, the grievance in the O.P., against which this revision is filed, would not survive. Therefore, the civil revision petition is liable to be dismissed. 6.
Accordingly, the Civil Revision Petition is dismissed. It is made clear that if the petitioners have any other grievance against the 1st respondent, it is open to them to work out the remedies as available under law.
Consequently, miscellaneous petitions if any pending in the revision shall stand dismissed. No order as to costs. _______________ P. NAVEEN RAO, J 27th September, 2016 cbs
