THE HON'BLE SRI JUSTICE A.RAMALINGESWARA RAO WRIT PETITION No.22647 of 2014 ORDER:

Heard the learned counsel for the petitioner and the learned Government Pleader for the respondents.

This writ petition is filed by a Co-operative Housing Society Limited and the term of Managing Committee expired on 21.03.2011. No elections were conducted to the Society thereafter. Though initially, a Person-in-Charge was appointed, the term of the said Person-in-Charge also expired on 02.04.2012. Thereafter, though the Person-in-Charge tried to conduct elections, the elections could not be conducted.

Counter affidavit filed by the respondents states that on the proposals of the Commissioner for Cooperation and Registrar of Cooperative Societies in letter dated 08.08.2014, the orders are awaited from the Government. The counter affidavit further states that, since the Society is not a State Aided Society, they themselves have to conduct elections under Section 43 of the A.P.Cooperative Societies Act, 1964, before the expiry of the term.

In view of the above facts and circumstances stated in the counter affidavit filed by the respondents, it is open to the General Body of the petitioner-Society to take a decision to conduct elections in accordance with the provisions of the A.P.Cooperative Societies Act, 1964. For the said purpose, the deponent of petitioner-Society can call for a meeting since the period of the Person-in-Charge is not extended. Accordingly, this writ petition is disposed of. There shall be no order as to costs. As a sequel, miscellaneous petitions, if any pending

in this writ petition, shall stand closed.
