Plaintiff filed O.S.No.9 of 2008 (New) O.S.No.t2L of 2004 (Old) on the file of Senior Civil Judge, Zaheerabad for recovery of money and the same was decreed, against which the appellant/defendant preferred the present Appeal Suit before this Court.

Heard both sides. Both the counsel represented that a memo was filed on 19.09.2011 stating that the sole appellant died on 27.02.2009 and the details of the L.R.s were also furnished. No steps were taken to bring the L.Rs on the record. Therefore, no purpose would be served in continuing the Appeal Suit. 3.

Accordingly, the Appeal Suit is dismissed as abated. No order as to costs.
