THE HON'BLE SRI JUSTICE SANJAY KUMAR WRIT PETITION No. 2151 of 2016 ORDER:

Though the petitioners pray for quashing of the charge sheet in PRC No.8 of 2015 in Crime No.37 of 2014 on the file of the learned Judicial First Class Magistrate, Siddipet, it is manifest from the record that the learned Magistrate passed a docket order on 19.05.2015 taking cognizance not only under the provisions mentioned in the final report but by also adding others. If the petitioners are aggrieved by this order, they are provided an efficacious alternative remedy under the Statute itself. Without taking recourse to the same, they have chosen to approach this Court by way of this writ petition. Normally, the extra ordinary jurisdiction of this Court should not be invoked in the event an efficacious alternative statutory remedy is available. On this short ground, the Writ Petition is dismissed leaving it open to the petitioners to avail the remedy afforded to them by law. Pending miscellaneous petitions, if any, shall also stand closed in the light of this final order. No order as to costs.
