HONOURABLE SRI JUSTICE RAJA ELANGO CIVIL REVISION PETITION Nos:5160 & 5190 OF 2016 COMMON ORDER:

1. Since the issue involved in the above revisions is one and the same, both the revisions are heard together and are being disposed of by this common order.

2. C.R.P.No.5160 of 2016 is filed by the petitioner-plaintiff aggrieved by order dated 24.8.2016 passed in I.A.No.874 of 2016 in O.S.No.93 of 2008 by the Senior Civil Judge, Peddapuram, East Godavari District and C.R.P.No.5190 of 2016 is filed by the petitioners-defendants Nos.3 and 4 aggrieved by order dated 24.8.2016 passed in I.A.No.847 of 2016 in O.S.No.182 of 2011 by the Senior Civil Judge, Peddapuram, East Godavari District.

3. The petitioner in CRP No.5160 of 2016 is the plaintiff in O.S.No.93 of 2008 and defendant No.4 in O.S.No.182 of 2011. The respondent in CRP No.5160 of 2016 is the plaintiff in O.S.No.182 of 2011 and the defendant in O.S.No.93 of 2008 and he is the father of the petitioner in CRP No.5160 of 2016. The father filed I.A.No.874 of 2016 in O.S.No.93 of 2008 and I.A.No.847 of 2016 in O.S.No.182 of 2011 on the file of the Senior Civil Judge, Peddapuram, seeking to club both the suits for common trial in order to avoid conflict of opinion. The said I.As were allowed. Aggrieved by the same, the son filed both the revisions.

4. Heard and perused the material available on record.

5. Both the suits are filed for partition of the joint family properties. Considering the facts and circumstances of the case and the nature of the

suits and the relationship among the parties, this Court is not inclined to interfere with the orders under revisions. However, the trial Court is directed to complete the common trial in the above suits and dispose of the same as expeditiously as possible, within a period of six months from the date of receipt of a copy of this order.

6. Accordingly, both the Civil Revision Petitions are disposed of. No costs. Consequently, miscellaneous petitions pending, if any, shall stand closed.
