Heard learned counsel for the petitioner and learned Government Pleader for Revenue appearing for the respondents. 2.
Alleging that the assignment conditions were violated and no house was constructed on the plot allotted to the husband of the petitioner, the Tahsildar, V.V. Palem Mandal, Prakasam District, passed orders on 24.05.2017 to resume the subject land. Aggrieved thereby, petitioner preferred appeal before the Revenue Divisional Officer-cum-Sub-Collector, Kandukur Revenue Division, Prakasam District, bearing Rc.No.4473/17. Petitioner alleges that application to grant stay of the order of the Tahsildar is also filed and the same is pending consideration. Petitioner claims that so far no decision is taken on his application and on the contrary, respondents are trying to evict him from the subject property. 3.
Having regard to the same, without expressing any opinion on the merits of the case, the Writ Petition is disposed of directing the Revenue Divisional Officer, Kandukur Revenue Division, Prakasam District, to consider the interlocutory application for grant of stay, if the same is filed and pending before him, within a period of three weeks from the date of receipt of a copy of this order. Till a decision is made by the Tahsildar in the interlocutory application for grant of stay, the parties are direction to maintain status quo obtaining as on today. There shall be no order as to costs.
Miscellaneous Petitions, if any, filed in this Writ Petition shall stand closed.
