Heard the learned Counsel for the petitioner and the learned Government Pleader for the respondents.
This Writ Petition was filed challenging the action of the third respondent in obtaining the signature of the petitioner on the alleged letter of resignation in respect of fair price shop dealership held by the petitioner and for a consequential direction to the second respondent not to accept the said letter of resignation, which was taken from the petitioner in respect of shop No.21 of Ellankivaripalli Village, Pulicherla Mandal in Chittoor District. The case of the petitioner is that his authorisation is subsisting till 31.03.2016. When the stock was not released to the petitioner, he enquired in the office of respondent Nos.2 and 3 and came to know that the alleged letter of resignation was forwarded to the second respondent. In those circumstances, he submitted representations to the second respondent on 03.01.2015 and 12.02.2015.
It is submitted by the learned Counsel for the petitioner that, pursuant to the representations made by the petitioner, an enquiry was also directed by the second respondent, and the enquiry, in fact, was completed. In the circumstances, this Writ Petition is disposed of directing the second respondent to communicate the order, pursuant to the enquiry, to the petitioner within a period of one week, and if the alleged letter of resignation is found to be false, the petitioner shall be continued as a fair price shop dealer. The Writ Petition is, accordingly, disposed of. The miscellaneous petitions pending, if any, shall stand closed. There shall be no order as to costs.
