THE HON'BLE SRI JUSTICE S. RAVI KUMAR C.R.P. No. 5761 of 2008 ORDER:

This Revision is preferred against order dt.17.09.2008 in I.A.No.870 of 2007 in O.S.No.66 of 2007 on the file of the I Additional Senior Civil Judge, Ranga Reddy District.

2. The revision petitioner herein filed the above referred I.A. invoking order I Rule 10 CPC with a request to implead him as 10th defendant in the said suit on the ground that he purchased the suit property.

3. The said application was resisted by the plaintiff on the ground that he is not a proper and necessary party and the suit is for bare injunction and the plaintiff claimed injunction only against the defendants 1 to 9 who tried to interfere with the plaintiff's possession and as the suit for injunction is only a personal action against the persons causing interference, his presence is not necessary.

4. The trial Court dismissed the said application.

5. Questioning the same, present Revision is filed.

6. In spite of posting this matter under the caption "specially identified cases at 2.30 p.m.", neither the advocate for revision petitioner appeared nor any representation is made on his behalf.

7. Therefore, this Civil Revision Petition is dismissed for nonprosecution. No costs.

8. As a sequel, miscellaneous petitions, if any, filed in this revision petition, shall stand dismissed.
