THE HON'BLE SRI JUSTICE M.S.K.JAISWAL CRIMINAL PETITION No.7751 of 2016 ORDER:
This petition under Section 482 Cr.P.C. is filed by the petitioners/A2 and A3 seeking to quash the proceedings in C.C.No.1013 of 2015 on the file of XXIII Metropolitan Magistrate, Rajendranagar, Ranga Reddy District, registered for the offences punishable under Sections 498-A and 420 I.P.C. and Sections 3 and 4 of Dowry Prohibition Act.
2. Heard learned counsel for the petitioners/A2 and A3 and learned Additional Public Prosecutor representing the State.
3. The petitioners herein are the parents-in-law and A1 is the husband of respondent No.2. The allegation against the petitioners is that they along with A1 harassed respondent No.2 physically and mentally for additional dowry.
4. A perusal of the complaint shows that there are serious allegations against the petitioners/A2 and A3. Therefore, it is not a fit case where the proceedings against them can be quashed. Truth or otherwise of the allegations can only be decided during the course of trial. However, considering the facts and circumstances of the case and as the first petitioner is aged person, the Court below is directed to proceed with the trial in C.C.No.1013 of 2015 without insisting the presence of the petitioners/A2 and A3 on each and every date of adjournment, unless it feels that their presence is necessary for any specific purpose. Further, the trial Court shall dispose of C.C.No.1013 of 2015 on its file within a period of three (3) from the date of receipt of a copy of this order.
5. With the above directions, the Criminal Petition is
disposed of.
Miscellaneous petitions, if any, pending in this criminal petition shall stand closed.
